We use tools from companies based in the USA or other third countries that are not secure under data protection law. When these tools are active, your personal data may be transferred to these third countries and processed there. We would like to point out that no data protection level comparable to that in the EU can be guaranteed in these countries. For example, US companies are obliged to hand over personal data to security authorities without you as the data subject being able to take legal action against this. Therefore, it cannot be ruled out that US authorities (e.g., intelligence services) may process, evaluate, and permanently store your data located on US servers for surveillance purposes. We have no influence on these processing activities.

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The legality of the data processing carried out before the revocation remains unaffected by the revocation.

Right to object to data collection in special cases and to direct advertising (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR DIRECT ADVERTISING PURPOSES (OBJECTION UNDER ART. 21(2) GDPR).

Right to lodge a complaint with a supervisory authority

In the event of breaches of the GDPR, the data subjects have the right to lodge a complaint with a supervisory authority, particularly in the member state of their habitual residence, place of work, or place of the alleged breach. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process based on your consent or in the performance of a contract automatically delivered to yourself or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another responsible party, this will only be done to the extent technically feasible.

SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Encrypted payment transactions on this website

If there is an obligation to send us your payment data (e.g., account number for direct debit authorization) after the conclusion of a fee-based contract, this data will be required for payment processing.

Payment transactions via common means of payment (Visa/MasterCard, direct debit) are processed exclusively via an encrypted SSL or TLS connection. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the payment data you transmit to us cannot be read by third parties.

Information, deletion, and correction

Within the scope of the applicable legal provisions, you have the right at any time to obtain information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, a right to correction or deletion of this data. For this purpose, as well as for further questions regarding personal data, you can contact us at any time.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. To do so, you can contact us at any time. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data happened/is happening unlawfully, you can request the restriction of data processing instead of deletion.
  • If we no longer need your personal data, but you need it for the exercise, defense, or assertion of legal claims, you have the right to request the restriction of the processing of your personal data instead of deletion.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, a balancing of your and our interests must be made. As long as it is not yet clear whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the assertion, exercise, or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a member state.

Objection to advertising emails

We hereby object to the use of contact data published as part of the imprint obligation for sending unsolicited advertising and information materials. The operators of these pages expressly reserve the right to take legal action in the event of unsolicited sending of advertising information, for example through spam emails.

Cookies

Our website uses so-called "cookies." Cookies are small text files and do not cause any damage to your device. They are either temporarily stored for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your device until you delete them yourself or until your web browser automatically deletes them.

In some cases, cookies from third-party companies may also be stored on your device when you enter our website (third-party cookies). These enable us or you to use certain services of the third-party company (e.g., cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies are used to evaluate user behavior or display advertising.

Cookies that are required to carry out the electronic communication process (necessary cookies) or to provide certain functions requested by you (functional cookies, e.g., for the shopping cart function) or to optimize the website (e.g., cookies to measure the web audience) are stored on the basis of Art. 6(1)(f) GDPR unless another legal basis is specified. The website operator has a legitimate interest in storing cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies has been requested, the relevant cookies are stored exclusively on the basis of this consent (Art. 6(1)(a) GDPR); the consent can be revoked at any time.

You can set your browser to inform you about the setting of cookies and to allow cookies only in individual cases, to exclude the acceptance of cookies for specific cases or in general, and to enable the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be restricted.

If cookies from third-party companies or for analysis purposes are used, we will inform you about this separately within the scope of this privacy policy and, if necessary, ask for your consent.

Mandatory legal retention periods remain unaffected. For details on data processing by Borlabs Cookie, please visit https://de.borlabs.io/kb/welche-daten-speichert-borlabs-cookie/.

The use of Borlabs Cookie's consent technology is to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.

Server log files

The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • Browser type and browser version
  • Operating system used
  • Referrer URL
  • Host name of the accessing computer
  • Time of the server request
  • IP address

This data is not merged with other data sources.

The collection of this data is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be recorded.

Contact form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not pass on this data without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR if your inquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested.

The data you enter in the contact form will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your inquiry has been processed). Mandatory legal provisions – in particular, retention periods – remain unaffected.

Inquiry by email, phone, or fax

If you contact us by email, phone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of processing your request.

The data you send to us via contact inquiries will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been processed). Mandatory legal provisions – in particular, statutory retention periods – remain unaffected.

5. Analysis tools and advertising

Google Analytics

This website uses features of the web analysis service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyze the behavior of website visitors. In doing so, the website operator receives various usage data, such as page views, dwell time, operating systems used, and the user's origin. This data is assigned to the respective user or their device by Google, if necessary.

Furthermore, we can use Google Analytics to record your mouse and scroll movements and clicks. Additionally, Google Analytics uses various modeling approaches to supplement the collected data and applies machine learning technologies for data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analyzing user behavior (e.g., cookies or device fingerprinting). The information collected by Google about the use of this website is generally transmitted to a Google server in the USA and stored there.

The use of this analysis tool is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in analyzing user behavior to optimize both its web offering and its advertising. If a corresponding consent was requested (e.g., consent to store cookies), the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; the consent can be revoked at any time.

The data transfer to the USA is based on the EU Commission's standard contractual clauses. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

IP anonymization

We have activated the IP anonymization function on this website. As a result, your IP address is shortened by Google within member states of the European Union or other contracting states of the Agreement on the European Economic Area before transmission to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

Browser plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

More information on the handling of user data by Google Analytics can be found in Google's privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.

Order processing

We have entered into a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Storage period

Data stored by Google at the user and event level that is linked to cookies, user IDs (e.g., User ID), or advertising IDs (e.g., DoubleClick cookies, Android advertising ID) is anonymized or deleted after two months. Details can be found at the following link: https://support.google.com/analytics/answer/7667196?hl=en.

Google Ads

The website operator uses Google Ads. Google Ads is an online advertising program of Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Ads enables us to display advertisements in the Google search engine or on third-party websites when the user enters certain search terms on Google (keyword targeting). Additionally, targeted advertisements can be displayed based on the user data available at Google (e.g., location data and interests) (audience targeting). We, as the website operator, can quantitatively evaluate this data by analyzing, for example, which search terms led to the display of our advertisements and how many ads resulted in corresponding clicks.

The use of Google Ads is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in marketing its services and products as effectively as possible.

The data transfer to the USA is based on the EU Commission's standard contractual clauses. Details can be found here: https://policies.google.com/privacy/frameworks and https://privacy.google.com/businesses/controllerterms/mccs/.

Google Remarketing

This website uses the functions of Google Analytics Remarketing. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Remarketing analyzes your user behavior on our website (e.g., clicks on certain products) to assign you to certain advertising target groups and subsequently display suitable web messages to you when you visit other online offerings (remarketing or retargeting).

Furthermore, the advertising target groups created with Google Remarketing can be linked to Google's cross-device features. This allows interest-based, personalized advertising messages that have been adapted to you based on your previous usage and surfing behavior on one device (e.g., a mobile phone) to be displayed on another of your devices (e.g., tablet or PC).

If you have a Google account, you can object to personalized advertising at the following link: https://www.google.com/settings/ads/onweb/.

The use of Google Remarketing is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in marketing its products as effectively as possible. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; the consent can be revoked at any time.

Further information and the privacy policies can be found in Google's privacy policy: https://policies.google.com/technologies/ads?hl=en.

Google Conversion Tracking

This website uses Google Conversion Tracking. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

With the help of Google Conversion Tracking, Google and we can determine whether the user has performed certain actions. For example, we can evaluate which buttons on our website were clicked how often and which products were particularly frequently viewed or purchased. This information is used to create conversion statistics. We learn the total number of users who clicked on our ads and what actions they performed. We do not receive any information with which we can personally identify the user. Google itself uses cookies or comparable recognition technologies for identification purposes.

The use of Google Conversion Tracking is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in analyzing user behavior to optimize both its web offering and its advertising. If a corresponding consent has been requested (e.g., consent to store cookies), the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; the consent can be revoked at any time.

More information about Google Conversion Tracking can be found in Google's privacy policy: https://policies.google.com/privacy?hl=en.

6. Newsletter

Newsletter data

If you would like to receive the newsletter offered on the website, we require an email address from you as well as information that allows us to verify that you are the owner of the provided email address and agree to receive the newsletter. No further data is collected or is only collected on a voluntary basis. We use newsletter service providers described below for handling the newsletter.

MailChimp

This website uses the services of MailChimp for sending newsletters. The provider is The Rocket Science Group LLC, 675 Ponce De Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA.

MailChimp is a service that helps organize and analyze the distribution of newsletters. If you provide data for the purpose of receiving newsletters (e.g., email address), this data is stored on MailChimp's servers in the USA.

MailChimp allows us to analyze our newsletter campaigns. When you open an email sent with MailChimp, a file contained in the email (called a web beacon) connects to MailChimp's servers in the USA. This allows us to determine whether a newsletter message has been opened and which links, if any, have been clicked. Additionally, technical information is collected (e.g., time of retrieval, IP address, browser type, and operating system). This information cannot be assigned to the respective newsletter recipient. It is used exclusively for the statistical analysis of newsletter campaigns. The results of these analyses can be used to better tailor future newsletters to the interests of the recipients.

If you do not want MailChimp to analyze your behavior, you must unsubscribe from the newsletter. We provide a corresponding link in every newsletter message for this purpose.

The data processing is based on your consent (Art. 6(1)(a) GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

The data you provide to us for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from both our servers and MailChimp's servers after you unsubscribe from the newsletter. Data stored by us for other purposes (e.g., email addresses for the members area) remain unaffected.

The data transfer to the USA is based on the EU Commission's standard contractual clauses. Details can be found here: https://mailchimp.com/eu-us-data-transfer-statement/ and https://mailchimp.com/legal/data-processing-addendum/#Annex_C_-_Standard_Contractual_Clauses.

After you unsubscribe from the newsletter, your email address may be stored in a blacklist by us or the newsletter service provider, if necessary, to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with the legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). The storage in the blacklist is not time-limited. You may object to this storage if your interests outweigh our legitimate interest.

Further information on the privacy practices of MailChimp can be found at: https://mailchimp.com/legal/terms/.

Order processing

We have entered into a contract for order processing (AVV) with the above-mentioned provider. This is a legally required contract that ensures the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

7. Plugins and tools

Google Web Fonts (local hosting)

This site uses so-called web fonts provided by Google to ensure the uniform display of fonts. The Google Fonts are installed locally. There is no connection to Google servers in this process.

Further information about Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google's privacy policy: https://policies.google.com/privacy?hl=en.

Google Maps

This site uses the Google Maps map service. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

To use the functions of Google Maps, it is necessary to store your IP address. This information is generally transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transmission. When Google Maps is activated, Google may use Google Web Fonts for the uniform display of fonts. When you call up Google Maps, your browser loads the required web fonts into your browser cache to display texts and fonts correctly.

The use of Google Maps is in the interest of an appealing presentation of our online offers and easy location of the places we indicate on the website. This represents a legitimate interest within the meaning of Art. 6(1)(f) GDPR. If a corresponding consent was requested, the processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR; the consent can be revoked at any time.

The data transfer to the USA is based on the EU Commission's standard contractual clauses. Details can be found here: https://privacy.google.com/businesses/gdprcontrollerterms/ and https://privacy.google.com/businesses/gdprcontrollerterms/sccs/.

More information on the handling of user data can be found in Google's privacy policy: https://policies.google.com/privacy?hl=en.

8. eCommerce and payment providers

Processing data (customer and contract data)

We collect, process, and use personal data only to the extent necessary for establishing, content development, or changing the legal relationship (inventory data). This is done on the basis of Art. 6(1)(b) GDPR, which allows the processing of data for the fulfillment of a contract or pre-contractual measures. We collect, process, and use personal data about the use of this website (usage data) only to the extent necessary to enable the user to use the service or to bill for it.

The collected customer data will be deleted after the completion of the order or the termination of the business relationship. Legal retention periods remain unaffected.

Data transfer upon conclusion of a contract for online shops, merchants, and goods shipment

If you order goods from us, we will pass on your personal data to the transport company responsible for the delivery and to the payment service provider responsible for the payment processing. Only the data that the respective service provider needs to fulfill its task will be disclosed. The legal basis for this is Art. 6(1)(b) GDPR, which allows the processing of data for the fulfillment of a contract or pre-contractual measures. If you have given your consent in accordance with Art. 6(1)(a) GDPR, we will pass on your email address to the transport company responsible for the delivery so that the latter can inform you by email about the shipping status of your order; you can revoke this consent at any time.

Data transfer upon conclusion of a contract for services and digital content

We transfer personal data to third parties only if this is necessary in the context of the contract processing, for example, to the credit institution responsible for the payment processing.

No further transfer of data will take place unless you have expressly consented to such a transfer. Your data will not be disclosed to third parties without your explicit consent, for example, for advertising purposes.

The legal basis for the data processing is Art. 6(1)(b) GDPR, which allows the processing of data for the fulfillment of a contract or pre-contractual measures.

Payment services

We integrate payment services from third-party companies on our website. If you make a purchase from us, your payment data (e.g., name, amount, account details, credit card number) will be processed by the payment service provider for the purpose of payment processing. The respective payment service providers are responsible for these transactions. The respective contract and privacy provisions of the respective providers apply. The use of the payment service providers is based on Art. 6(1)(b) GDPR (contract processing) and in the interest of a smooth, convenient, and secure payment process (Art. 6(1)(f) GDPR). If your consent is requested for certain actions, Art. 6(1)(a) GDPR is the legal basis for data processing; consent can be revoked at any time.

We use the following payment services/providers within this website:

The controller has integrated components of secupay, credit card and PayPal via secupay from secupay AG (hereinafter referred to as "secupay"), Goethestr. 6, 01896 Pulsnitz. Secupay is a payment institution within the meaning of the Payment Services Supervision Act (ZAG) and is registered with the Federal Financial Supervisory Authority (BaFin), Graurheindorfer Str. 108, 53117 Bonn (registration number: 126737), enabling cashless payment of products and services on the Internet.

Secupay implements a process by which the purchase price claim is assigned to secupay. This enables a merchant to deliver goods, services, or downloads immediately after the order to the customer.

If you select "prepayment/transfer," "credit card," or "SOFORT" as the payment method during the order process in our online shop, data will automatically be transmitted to secupay. By selecting this payment option, you consent to the transmission of personal data required for payment processing.

When processing payment by "credit card," you, as the buyer, provide the payment method data to secupay. Secupay then performs a technical check of the risk of payment default. The result of the transaction is then automatically communicated to the online merchant.

The personal data exchanged with secupay includes first name, last name, address, email address, IP address, phone number, or other data necessary for payment processing. The data is transmitted for the purpose of payment processing and fraud prevention. The controller will also transmit other personal data to secupay if there is a legitimate interest for the transmission. The personal data exchanged between secupay and the controller may be transmitted by secupay to credit reporting agencies. This transmission is intended to verify identity and creditworthiness. The identity and creditworthiness check is not carried out when paying by prepayment.

Secupay may pass on personal data to affiliated companies and service providers or subcontractors if this is necessary to fulfill the contractual obligations or the data is to be processed on behalf.

You have the option to revoke your consent to the handling of personal data at any time vis-à-vis secupay. A revocation does not affect personal data that must be processed, used, or transmitted for (contractual) payment processing.

The applicable privacy policy of secupay can be accessed at https://www.secupay.com/en/datenschutz.

When paying with Sofort via secupay, the online payment system of SOFORT GmbH, Theresienhöhe 12, D-80339 Munich, the data you provide during the ordering process will be entered into the digital transfer form provided by SOFORT GmbH and transmitted to your bank along with your online banking data (PIN and TAN) encrypted for the purpose of processing the transfer. Your online banking data will not be stored by the controller, secupay, or SOFORT GmbH. SOFORT GmbH is part of the Klarna Group (Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden). The privacy policy can be accessed via the following link: https://cdn.klarna.com/1.0/shared/content/legal/terms/0/en_us/privacy.

Miss nothing!First name, name, e-mail — that's all. You'll get a confirmation mail, GDPR requires it. Then we'll be in touch when the new winter starts.
